Class Action Facts: Progressive Insurance Company, Inc., is one of the largest auto insurance groups in the country. This class action is brought on behalf of their current and former employees with job titles including Claims Adjuster, Claims Representative, Claims Generalist Associate, among others.

Plaintiff entered into a contract with Progressive to provide automobile collision and comprehensive insurance coverage for a "stated amount." Progressive used this "stated amount" to underwrite insurance coverage and to determine the amount of the premiums to be paid by the insured for
the insurance coverage for this "stated amount."

In many cases, the "stated amount" exceeded the actual value of the insured vehicle at the time of underwriting, using the valuation methods used by Progressive to adjust losses, which excess was known to Progressive at the time of underwriting and issuance of the policies. Nevertheless, and despite the fact that Progressive knew that it would not provide an amount of insurance equal to the "stated amount," Progressive charged a premium based upon the "stated amount" without disclosing either said actual value at the time of underwriting or issuance of the policies or the method and source material by which the actual value would be determined by Progressive should there be a "total loss. "

As a result of the way Progressive computed premiums, and because Progressive did not disclose the way "actual value" would be determined in the event of a "total loss," Plaintiff and the other members of the Class paid for insurance which was not provided and/or which Progressive did not intend to provide.

Class Action Settled: United Financial Casualty Company, Progressive Casualty Insurance Company, Progressive Preferred Insurance Company, Artisan and Truckers Casualty Company paid a total amount of $2,500,000 in complete and full satisfaction and settlement for the entire approved proposed class, and payment of any approved attorney’s fees and litigation costs..
