Progressive Casualty Insurance Company Class Action Lawsuit

Class Action Defendants: Progressive Casualty Insurance Company, Inc.

Class Action Facts: Progressive Casualty Insurance Company, Inc., is one of the largest auto insurance groups in the country. This class action is brought on behalf of their current and former employees with job titles including Claims Adjuster, Claims Representative, Claims Generalist Associate, among others.

These employees did not receive their proper payment of wages, including:

  • one and one-half times their regular rate of pay for hours worked over eight (8) hours per day,
  • one and one-half times their regular rate of pay for hours worked over forty (40) hours per week, and
  • two times their regular rate of pay for all hours in excess of twelve (12).

Progressive also required it's employees to work "off-the-clock."

Employees who resigned or were terminated were not paid all compensation, including wages, commissions and bonuses due upon termination.

Progressive also failed to follow laws requiring them to provide their employees with an accurate itemized statement in writing showing, among other things,

  1. gross wages earned,
  2. total hours worked by each respective individual,
  3. all deductions,
  4. net wages earned and/or
  5. all applicable hourly rates in effect during each respective pay period and the corresponding number of hours worked by each respective individual.

Class Action Relief Sought: (1) payment for overtime and double-time owed to Claims Adjuster, Claims Representative, Claims Generalist Associate, among others; (2) payment of wages, commissions and bonuses owed when employees resigned or were terminated; (3) penalties owed by law for unpaid wages; and (4) an injunction to prevent Progressive from continuing this practice into the future.
